Terms of Service

These Terms of Service ("Terms") govern your access to and use of NicheRecon ("the Service"), a market-intelligence platform operated by Vishal Kundar, a sole proprietor based in Bangalore, Karnataka, India ("NicheRecon", "we", "us", "our"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About us
The Service is provided by Vishal Kundar (sole proprietor), Bangalore, Karnataka, India. You can reach us at nicherecon.help@outlook.com.
2. Eligibility
You must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872 to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Your account
We use passwordless, email one-time-passcode (OTP) authentication. You are responsible for maintaining access to the email address associated with your account and for all activity that occurs under your account. Notify us promptly at nicherecon.help@outlook.com if you suspect any unauthorised use. We may refuse, suspend, or terminate accounts at our discretion where these Terms are breached.
You may add optional profile details (such as a name, business name, and city) on the Account & Settings page; you agree to keep any details you provide accurate. You can delete your account yourself at any time from Account & Settings → Delete account — deletion is immediate and permanent, and the handling of your data on deletion is described in our Privacy Policy.
4. Plans, fees and billing
The Service is offered on a Free plan and on paid plans (currently Radar and Radar Pro), plus optional one-time purchases (Launch Reports and on-demand research credits). The features and current prices of each plan are shown on our pricing page and at checkout.
Paid plans do not auto-renew. Each plan purchase is a one-time payment that activates the plan for a fixed validity period (currently 30 days), shown at checkout and in the app. When the period ends the plan lapses automatically back to Free; no further charge is made and no cancellation step is required. You can renew at any time by purchasing again; renewing before expiry extends your remaining validity. Any unused chat queries or purchased credits remain on your account after a plan lapses. All prices are in Indian Rupees (₹) and, unless stated otherwise, are inclusive of applicable taxes.
Payments are processed by our payment partner, Cashfree Payments. We do not store your full card or banking details. By making a payment you also agree to the payment provider's terms.
5. Refunds and cancellations
Fees are non-refundable except as required by law. Because plans do not auto-renew, there is nothing to cancel: your access simply continues until the end of the current validity period and then lapses. One-time purchases (Launch Reports and on-demand research), once generation or processing has started, are non-refundable; if one fails to deliver due to an error on our side, we refund it or replace the credit. 6. Nature of the Service: informational only
NicheRecon provides market-intelligence signals, scores, maps, and analyses derived from a combination of third-party data and our own modelling. This information is provided for general informational purposes only. It is not financial, investment, legal, tax, or professional advice, and it does not guarantee any business outcome.
Underlying data may be incomplete, delayed, estimated, or inaccurate, and some figures are modelled or proxied. You are solely responsible for any decisions you make based on the Service, and you should carry out your own due diligence.
7. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- scrape, crawl, bulk-export, resell, redistribute, or sublicense the data or outputs except as expressly permitted;
- reverse engineer, decompile, or attempt to extract source code or underlying models, except where the law permits;
- circumvent authentication, plan limits, rate limits, or other access controls;
- upload malware, or interfere with, overload, or disrupt the Service or its infrastructure; or
- misrepresent your identity or infringe the rights of others.
8. Intellectual property
The Service, including our market-intelligence scores, rankings, analyses, software, design, and content, is the original work product of NicheRecon and is protected by applicable intellectual-property laws. Third-party data displayed through the Service remains the property of its respective owners (see our Data Sources & Credits).
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal business purposes. No other rights are granted.
Feedback. If you send us feedback, suggestions, or ideas about the Service (including through the in-app "Leave feedback" form), you grant us a perpetual, irrevocable, royalty-free licence to use them to operate and improve the Service, without any obligation or compensation to you. Feedback is voluntary; please do not include confidential information or another person's personal data in it.
9. Third-party data and services
The Service relies on third-party data providers and infrastructure, including Google Maps Platform, OpenStreetMap, OLA Maps, Cashfree Payments (payments), Azure Communication Services (email), and our hosting provider. Your use of features powered by these providers may also be subject to their respective terms and policies. We are not responsible for third-party services or for the accuracy of third-party data. 10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
11. Limitation of liability
To the maximum extent permitted by law, NicheRecon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Service shall not exceed the total fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless NicheRecon from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.
13. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time and close your account yourself from the Account & Settings page in the app. Closing your account ends your access immediately, including any remaining plan validity or unused credits, which are not refunded except as required by law (see our Refunds & Cancellations policy). Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
14. Changes to the Service and these Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any non-waivable rights you may have, the courts at Bangalore, Karnataka shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
